MusicHype Inc, (hereafter ‘AE’) is committed to protect your personal data and to respect your privacy. AE collects and further processes personal data pursuant to Regulation (EU) 2018/1725 of the European Parliament and of the Council of 23 October 2018 on the protection of natural persons with regard to the processing of personal data by the Union institutions, bodies, offices and agencies and on the free movement of such data (repealing Regulation (EC) No 45/2001).

We’ve updated this privacy policy (this “Policy”) to ensure that we communicate to you, in the clearest way possible, how we treat information that we collect through the theappreciationengine.com (the “Site”) and Appreciation Engine (“AE” or the “Service”), a service that we make available to our business customers (“Customers”). Our Customers use AE together with their sites and online services (each, a “Customer Platform”) to collect information about their users (“you” or a “User”). We encourage you to read this Policy carefully.  This Policy does not apply to the activities of our Customers on the Customer Platforms, or to any other site or service that does not link to this Policy, and we encourage you to review the policies applicable to those sites and services to better understand how they collect, use, and disclose your information.

 

Information We Collect

The personal information we collect depends on how you interact with us, the Services you use, and the choices you make. We collect and process personal information about you with your consent and/or as necessary to provide the products you use, operate our business, meet our contractual and legal obligations, protect the security of our systems and our customers, or fulfil other legitimate interests. When you are asked to provide personal information, you may decline. But if you choose not to provide information that is necessary for certain products or features, those products or features may not be available or function correctly.

 

Information you provide through AE as a User

AE may collect personal information directly from you when you use AE through a Customer Platform. When you connect your social media account to AE, we will collect certain information about you on behalf of our Customers from the applicable social media service (each, a “Social Media Service”). For example, your use name and login details, interests, connections with other users, your posts, likes, streaming listens, and profile information. If you have provided AE with permission through your Social Media Service settings, we may also be provided with certain location information collected on the applicable Social Media Service. Your permissions with the applicable Social Media Service will select what types of information is provided through AE by the Social Media Service.

 

Information you provide to us if you are a Customer

If you are a Customer or a potential Customer, we may collect certain information from you as you register for and use the Service. When you register for the Service, we may collect information such as login details, contact information, and business information. When you sign up for billing, we may, through our third party payment processor, collect certain payment and billing information. We may also collect any information you provide us through your contact with our support team.

 

Information we collect about you automatically and disclosed with third parties

We may automatically collect information related to your use of the Site, AE, and Customer Platforms – for example, we collect your computer’s or mobile device’s operating system type and version, Internet Protocol (IP) address, mobile device ID, access times, browser type and language, and the websites you visited before coming to the Site. In providing the Service and the Site, we utilize “cookies”.  A cookie is a small text file that is stored on your computer for record-keeping purposes and includes a unique identifier that distinguishes your computer or mobile device from other devices. We and some of our third-party service providers may use a combination of “persistent cookies” (cookies that remain on your hard drive for an extended period of time) and “session ID cookies” (cookies that expire when you close your browser) on the Site and Services to, for example, track overall site usage, remember your preferences, and generally improve user experience. We and others may also use other technologies for tracking, such as pixel tags and web beacons. Web beacons and pixel tags are electronic images that may be used on the Service, Site, or in our emails. We use web beacons, for example, to deliver cookies, count visits, understand usage of the Site and Services, and tell if an email has been opened and acted upon. Our third-party advertising partners include: Facebook Ads (Facebook Ads Privacy Policy, Changing Ad Settings) Google Adwords (Google Adwords Privacy Policy, Opting out of Google Ads) . We have no access to or control over information collected from cookies or tracking technologies used by our third-party service providers.  This Policy covers our use of cookies only and does not cover the use of cookies by any third parties.  You should consult their privacy policies for more information about their use of cookies on our site. We may combine information you provide with data we collect automatically.

 

Third Party Transfer and Lawful Requests

AE does not transfer data to third parties outside of its service, unless our liability in certain cases requires an onward transfer to third parties, like in response to a lawful request by public authorities, including meeting national security or law enforcement requirements, but not exclusively those purposes.

AE, and the personal data we hold, is also subject to any investigatory and enforcement powers of the Federal Trade Commission (FTC).

 

Commonly owned entities, affiliates and change of ownership

If we are involved in a bankruptcy, merger, acquisition, reorganization, or sale of assets, your Personal Information may be accessed, sold or transferred as part of that transaction and this Privacy Policy will apply to your Personal Information as transferred to the new entity.

 

How we use your information

 

If you are a User

We may process the information collected through AE for the applicable Customer in a variety of ways, including to provide them a variety of services, to engage in data aggregation, segmentation, and reporting. The information collected through AE on a given Customer Platform is made available to the applicable Customer for their own use. This Policy does not apply to our Customers use of your information and you should consult their Privacy Policy to better understand how they use your information. We may also process the information collected through AE for our own purposes, including to:

  • to create aggregate data that we may use for purposes of reports and/or whitepapers;
  • to understand how you and other Users are using AE in order to make it better;
  • to protect our business, Customers, or users; and
  • to protect, investigate, and deter against fraudulent, unauthorized, infringing or illegal activity.

 

 

If you are a Customer or a prospective Customer

We may process the information collected through the Site in a variety of ways, including to:

  • to understand how you are using the Site in order to make it better;
  • to personalize your experience, suggest and offer you relevant content and recommendations, and display marketing and advertising tailored to your preferences on Site and other websites;
  • to process and fulfill your requests or orders;
  • for marketing purposes, including sending you emails about products, events, promotions and offers;
  • to send you service information, including confirmations, invoices, notices, updates, security alerts, and support and administrative messages;
  • to respond to your comments and questions and provide customer service;
  • for analyzing marketing and advertising effectiveness;
  • to enforce our terms and conditions or protect our business, partners or users; and
  • to protect, investigate, and deter against fraudulent, unauthorized, infringing or illegal activity.

 

 

We aggregate certain information we collect about Users

We may create, use, and disclose aggregated and anonymized data collected through AE and other sources for its own purposes, including, but not limited, to:

  • assist us to better understand how our customers are using AE,
  • provide our customers with further information regarding the uses and benefits of the Service,
  • enhance business productivity, including without limitation by creating useful business insights from that aggregated data, and
  • otherwise to improve the Service.

 

 

How we share your information

We may share information with your consent. We provide the information received through AE to the Customer who operates the applicable Customer Platform that you authorized through AE. The use of data by such third parties is subject to their respective privacy policies. We share information with certain third parties (including contractors and service providers) to provide services for us and to help with our operations, which may require that they access and use your information. In such cases, these companies must abide by data privacy and security requirements and are not allowed to use personal information they receive from us for any other purpose. We may share some or all of your information with our current or future “affiliates”, including a parent company, any subsidiaries, joint ventures, or other companies under common control, in which case we will require our affiliates to honor this Policy. We may also share your information with others in connection with or during negotiation of any merger, financing, acquisition, bankruptcy, dissolution, transaction or proceeding involving sale, transfer, divestiture or disclosure of all or a portion of our business or assets to another company. We may also share your information to (i) comply with laws or to respond to lawful requests and legal process, (ii) to protect the rights and property of us, our agents, Customers, and others, including to enforce our agreements, policies, and terms of use, or (iii) in an emergency to protect the personal safety of us, our Customers, or any person, or (iv) to investigate, prevent, or take action regarding illegal or suspected illegal activities. Finally, we may share aggregated, anonymized or statistical information about you, including demographics data, with others for a variety of purposes, including for their own uses, for example, for improving their products and services.

 

 

Information Access and Your Choices

 

You can revoke permissions to AE

By following the directions on the applicable Social Media Service, you can revoke permissions you’ve granted to AE and cease further sharing of information from that particular Social Media Service to AE. However, this will have no effect on information that has been already provided by the applicable Social Media Service to AE and we may still use such information as described in this policy and the applicable Customer Platform.

 

Access, correction, and deletion

If you wish to request access to, or correction or deletion of, personal information about you that we hold, you can contact us as described at the bottom of this privacy statement. However, to the extent permitted by applicable law, we reserve the right to charge a fee or decline requests that are unreasonable, excessive, or prohibited by law, could adversely affect the privacy or other rights of another person, or where we are unable to authenticate you as the person to whom the data relates.

 

Communication preferences

You can choose whether you wish to receive promotional communications from us. If you receive promotional email from us and would like to stop, you can do so by following the directions in that message. These choices do not apply to mandatory service communications that are part of certain of our products, or to surveys or other informational communications that may have their own unsubscribe method.

 

Cookie Choices

Many web browsers accept cookies by default. If you prefer, you can usually change your browser’s settings to reject and/or to remove many cookies. As the precise means by which you may do this will vary from browser to browser, please visit your browser’s help menu for more information. If you choose one of these options, your choices will apply only to the specific browser and device from which you opt out and will not affect other browsers or different devices.  Please note also that if you choose to reject or remove cookies, this may prevent certain features or services of our Site or AE from working properly. Advertising and Analytics

Our third-party analytics and advertising partners typically provide options to opt-out of certain information collection or use. See the “Information we collect about you automatically” section of this privacy statement for more details.

 

Do Not Track

While we and others give you certain choices, as further outlined in this Policy, there are many ways in which browser signals and similar mechanisms can indicate your choice to disable tracking, and we may not be aware of nor honor every such mechanism. For example, some browsers include the ability to transmit “Do Not Track” signals. Since uniform standards for “Do Not Track” signals have not been adopted, we do not currently process or respond to “Do Not Track” signals. We take steps to protect your personal information

We strive to protect your information by employing reasonable security measures to guard against unauthorized access, use, disclosure, modification, or destruction of your information. However, the Internet is not in itself a secure environment and we cannot give an absolute assurance that your information will be secure at all times. We encourage you to take care to protect your usernames and passwords to help prevent others from accessing your accounts and services.

 

Data Transfers and Retention

The personal information we collect may be stored and processed in your country or region, or in any other country where we or our affiliates, subsidiaries, or service providers maintain facilities. Specifically, we hold your information on servers located in the United States of America (the “U.S.”). The storage location(s) are chosen in order to operate efficiently, to improve performance, and to create redundancies in order to protect the data in the event of an outage or other problem. We take steps designed to ensure that the data we collect under this statement is processed according to the provisions of this statement and applicable law wherever the data is located. We transfer personal information from the European Economic Area and Switzerland to other countries, some of which have not been determined by the European Commission to have an adequate level of data protection. We retain personal information for as long as necessary to provide the products and fulfill the transactions you have requested, or for other essential purposes such as complying with our legal obligations, resolving disputes, and enforcing our agreements. Because these needs can vary for different data types in the context of different products, actual retention periods can vary significantly based on criteria such as user expectations or consent, the sensitivity of the data, the availability of automated controls that enable users to delete data, and our legal or contractual obligations. For example, if an account has been inactive for two years it will be deleted from our system.

 

European Data Protection Rights

If the processing of personal information about you is subject to European Union data protection law, you have certain rights with respect to that data:

  • You can request access to, and rectification or erasure of, personal information;
  • If any automated processing of personal information is based on your consent or a contract with you, you have a right to transfer or receive a copy of your personal information in a usable and portable format;
  • If the processing of personal information is based on your consent, you can withdraw consent at any time for future processing; and
  • You can object to, or obtain a restriction of, the processing of personal information under certain circumstances.

EU-U.S. Data Privacy Framework

Musichype Inc complies with the EU-U.S. Data Privacy Framework (EU-U.S. DPF) as set forth by the U.S. Department of Commerce. Musichype Inc has certified to the U.S. Department of Commerce that it adheres to the EU-U.S. Data Privacy Framework Principles (EU-U.S. DPF Principles) with regard to the processing of personal data received from the European Union in reliance on the EU-U.S. DPF.  If there is any conflict between the terms in this privacy policy and the EU-U.S. DPF Principles, the Principles shall govern. We remain responsible for all the personal information we receive under the DPF and that we subsequently transfer to third parties acting as agents on our behalf if they process personal information in a manner inconsistent with the DPF principles.

Dispute Resolution and Enforcement

We will investigate and attempt to resolve complaints and disputes regarding use and disclosure of such Personal Data in accordance with the principles contained in our Policy.

In compliance with the EU-U.S. DPF, Musichype Inc commits to refer unresolved complaints concerning our handling of personal data received in reliance on the EU-U.S. DPF to JAMS, an alternative dispute resolution provider based in the European Union. If you do not receive timely acknowledgment of your DPF Principles-related complaint from us, or if we have not addressed your DPF Principles-related complaint to your satisfaction, please visit https://www.jamsadr.com/DPF-Dispute-Resolution for more information or to file a complaint. The services of JAMS are provided at no cost to you.

In compliance with Annex 1 of the Data Privacy Framework program claims can possibly be arbitrated under certain conditions. This will be Binding Arbitration. The purpose of this option is to provide a prompt, independent, and fair mechanism, at the option of individuals, for resolution of any claimed violations of the Principles not resolved by any of the other EU-U.S. DPF mechanisms.
